Foreign Property Ownership Laws for Phuket, Thailand
For those looking to buy a villa or house in Phuket, it is essential to understand the law concerning foreign ownership of land. Thai law states that foreigners cannot own land directly in their name. However, they can own the structure on the land, i.e., in this case a house or villa. Foreign buyers of land, villas, or houses in Phuket have two possible ownership structures:
Thai Limited Company: The freehold of the land can be held in a corporate holding structure. However, this must be a company set up as a business to generate income, not purely a holding structure for the land. The Thai shareholders must have a minimum of 51%, and they cannot be nominees.
Leasing the Land: Alternatively, foreign buyers can lease the land. The maximum single lease period is 30 years, but developers often include options to renew for one or more additional 30-year periods.
