Land Ownership Structures for Foreign Investors

Foreigners cannot directly own land in Thailand but can legally own buildings. There are two options for acquiring land in Koh Samui: setting up a Thai limited company or leasing the land on a 30-year term:

A Thai company can hold the freehold title, but it must be a legitimate, operating business with proper financial records and compliance. The Thai shareholding must be at least 51% and the Thai shareholders need a genuine interest in the company, must be financially compensated and not merely nominees. Legal structures can be designed to allow foreign investors significant control within the company while adhering to Thai law.

Alternatively, land can be leased for a term of up to 30 years. More common when buying homes, smetimes a property developers will include additional lease extensions of 30 years each. However, it is critical that investors conduct due diligence to ensure the security of any lease extensions.

Land Titles in Thailand – What Buyers Need to Know

Nearly all of the land plots listed on our website come with a Chanote title, which is the highest level of land ownership in Thailand. Any subdivided plot will always have a Chanote title, ensuring clear ownership and accurate boundaries.

Chanote titles are issued by the Thai Land Department and are accurately surveyed and plotted in relation to the national survey grid. They are also marked by unique numbered posts set in the ground, ensuring precise boundary identification.

Another type of land title you may encounter is Nor Sor Sam Kor, which is the predecessor to Chanote. While still legally recognised, it is less precise in its land measurements, and ownership transfers can take longer.

For buyers, a Chanote title is the preferred option, as it guarantees the most secure ownership and allows for straightforward legal transfers.
